Voting requirements for impeachment

Just in case you haven’t seen it mentioned: It only takes a simple majority vote in the House of Representatives to impeach the President. But the Senate needs a 2/3 majority to convict him (and conviction would be expected to lead to removal from office, although the Senate doesn’t have to do that).

As Wikipedia puts it, being impeached is somewhat like being indicted, not convicted. In Clinton’s case, the House impeached him, but the Senate voted to acquit.

The day the nation demands impeachment is upon us. Sacks and sacks of mail are arriving in congress demanding impeachment via the House of Representative’s own rules. This legal document is as binding as if a State or if the House itself passed the impeachment resolution (H.R. 635).

There’s a little known and rarely used clause of the “Jefferson Manual” in the rules for the House of Representatives which sets forth the various ways in which a president can be impeached. Only the House Judiciary Committee puts together the Articles of Impeachment, but before that happens, someone has to initiate the process.

That’s where we come in. In addition to the State-by-State method, one of the ways to get impeachment going is for individual citizens like you and me to submit a memorial. ImpeachforPeace.org, part of the movement to impeach the president, has created a new memorial based on one which was successful in impeaching a federal official in the past. You can find it on their website as a PDF.

STOP WAITING FOR YOUR MEMBERS OF CONGRESS TO ACT FOR YOU.

You can initiate the impeachment process yourself by downloading the memorial, filling in the relevant information in the blanks (your name, state, etc.), and sending it in. Be a part of history.

Never been a clear definition of “high crimes and misdemeanors,” though. What’s the phrase for taking an action a reasonable person can assume will lead to someone getting hurt? (Shoot — too early in the morning for me.) You know, stuff like, “I didn’t mean to kill him, we were just throwing rocks at cars”?

Although Clinton sure seemed to have committed perjury, he wasn’t convicted of a crime — by impeaching him, the House effectively said, “We think he has committed a high crime or misdemeanor.” The Senate, though, disagreed.

Crimes?

Torture of prisoners, banned by the Geneva Convention. A violation of the law.
Illegal warrentless wiretapping - A violation of the law (inconvenience is not an excuse)
Kidnapping an American, exporting him to foreign soil to avoid that pesky court system
Violation his oath of office to “defend the constitution” by signing the bill that revokes beauteous corpus
Outing a CIA operative to discredit her husband. Also a violation of the oath of office.

And once the investigations start, I’m sure that their will be a lot more charges. Unfortunately, lying about a war, sending 3000 soldier to die in a fruitless war, and running up the debt and deficit aren’t crimes, although they should be.

I haven’t been secret at all for my contempt for this administration or the religious right-wingnuts that are giving conservatives a bad name. It takes a special type of contempt for America to loot the taxpayers by running up the deficit while spending like a crack whore (and acting like one as well) and giving your rich buddies tax cuts.

It is really important to have websites like these. I wonder if it would be good to start a petition and gather thousands and millions of signatures for impeachment.

I plan to visit the memorial website and submit my information. How many names on the memorial do you need to seriously talk about impeachment.

People need to speak up. We are the greatest Democracy ever where the people have the greatest potential for making change. Citizens in other countries probably scratch their heads about why the American citizenry is so passive about the policies of this president and confuse the passivity with support.

We need action. We need a leader. We need citizens to speak up and speak out.

The Constitution doesn’t allow for direct impeachment, and our elected representatives don’t have the backbone to impreach for the many offenses this Administration has committed.

Sometimes we get exactly what we deserve for not holding our government accountable.
